Welcome to SmartSite AI (“Company”, “we”, “our”, “us”).
By purchasing, accessing, or using any SmartSite AI services, you (“Client”, “you”, “your”) agree to these Terms of Service.
If you do not agree, do not use our services.

1. Description of Services

SmartSite AI provides digital services for small businesses, including:

SmartSite Website (website design, landing pages, service pages, copy structure optimized for conversion)
SelfQuote Widget (instant estimate, project information intake, optional image upload, optional initial AI-generated design preview)
WhatsApp Integration (pre-filled message button, lead forwarding)
Smart Follow-Up System (automated WhatsApp/email sequences, lead nurturing, reminders)
AI Bot Assistant (automated responses, lead capture, 24/7 support bot)
Automation Setup (Make/Zapier workflows, integrations with WhatsApp, Gmail, CRMs)
Domain & hosting guidance, DNS setup, Google Business page assistance

The exact features included depend on the package purchased.

2. No Guarantee of Specific Results

SmartSite AI improves website conversion structure and automates lead flow, but we do not guarantee:

A specific number of leads
A specific revenue outcome
A specific ad performance improvement
That ads, WhatsApp, or third-party systems will function without interruption

Marketing results depend on many factors outside our control (budget, market, competition, user behavior, ad quality, etc.).

3. Payments & Refund Policy

3.1 One-time Payments

Packages (Basic, Follow-Up, Pro) are charged as a one-time fee unless agreed otherwise.

3.2 Refunds

Due to the nature of digital labor, automation setup, and AI customization:

All sales are final and non-refundable, unless:

We fail to deliver the core service agreed upon
A refund is required under applicable consumer protection laws

Work that has already been completed cannot be refunded.

3.3 Additional Costs

You are responsible for:

Third-party software fees (Make.com, Zapier, WhatsApp API providers, hosting, domain fees)
Paid advertising spend (Google Ads, Meta Ads)
Any external services not explicitly included in your package

4. Client Responsibilities

By using our services, you agree to:

Provide accurate business information needed to build your SmartSite or automations
Ensure you have the right to use any content you provide (images, text, logos)
Follow WhatsApp Business policies, Google advertising policies, and any other platform rules
Obtain consent from your customers if you store or process their information
Not misuse the tools we build (spam messages, unlawful activities, harassment, fraud, etc.)

If you misuse the platform, SmartSite AI may suspend or terminate your services without refund.

5. AI-Generated Content & Limitations

Some outputs (estimates, messages, responses, design previews) may be generated or assisted by AI.
You acknowledge that:

AI outputs may contain inaccuracies
AI-generated estimates are not legally binding quotes
You are fully responsible for confirming all pricing sent to your customers
AI cannot replace professional judgment in construction, legal, or technical decisions

SmartSite AI is not liable for errors made by AI or for decisions based on AI-generated content.

6. Ownership of Content & Intellectual Property

6.1 What belongs to you

You own:

Your business content (logo, text you provide, photos, business information)
All leads collected through your site, form, WhatsApp, or automations
Any custom content you create manually

6.2 What belongs to SmartSite AI

We retain ownership of:

Automation workflows
SelfQuote logic, templates, question flows
AI prompts, scripts, and internal logic
Any proprietary designs, copy frameworks, or layouts
AI bots created by us
System structure, integrations, templates

You are granted a license to use the systems as long as they are hosted and active.

You may not resell, copy, or reuse our automations or systems for other businesses without written permission.

7. Lead Data & Privacy Responsibilities

The system may collect:

Name
Phone number
Email address
Project details
Images (if uploaded)
Messages sent through WhatsApp

You agree to:

Comply with local privacy laws (GDPR/CCPA when relevant)
Not share customer information unlawfully
Notify customers that responses or estimates may be AI-assisted
Use the collected data only for legitimate business purposes

SmartSite AI is not responsible for misuse or unauthorized access on the client’s end.

8. Third-Party Services & Downtime

SmartSite AI uses third-party platforms including but not limited to:

Make.com
Zapier
WhatsApp / Meta
Gmail / Google Workspace
Hostinger / WordPress
OpenAI or similar AI providers

We are not liable for:

Outages
API changes
System errors
Rate limits
Policy enforcement or bans from third-party services

We will always do our best to help troubleshoot, but these platforms operate independently.

9. Cancellation & Termination

SmartSite AI may suspend or terminate services if:

You violate these Terms
You misuse the automations
You engage in unlawful activities
You attempt to reverse-engineer our systems

No refunds will be issued in these cases.

You may request termination of ongoing services (if any), but one-time payments are non-refundable.

10. Indemnification

You agree to indemnify and hold harmless SmartSite AI from any claims, damages, or losses arising from:

Your use of the website or automations
Errors in your pricing or estimates
Misuse of customer data
Violations of third-party policies
Incorrect AI-generated outputs that you use without verification

11. Limitation of Liability

To the fullest extent permitted by law:

SmartSite AI is not liable for indirect, incidental, special, or consequential damages
Our total liability for any claim shall not exceed the amount you paid for the service

We do not provide legal, financial, engineering, or safety advice.

12. Updates to These Terms

We may update these Terms from time to time.
Continued use of our services constitutes acceptance of the updated Terms.
